Relocating After Divorce in Tennessee

So you want to move? A Guide for Tennessee Parents!

Do you know the notification requirements for moving? Are you moving out of state after divorce? Relocating after divorce can be very tricky and it can effect your custody arrangements.  How far can you move without triggering the Parental Relocation Statute? Tennessee has a very specific statute that must be followed.  It is so important that it is actually reprinted on the last page of your Tennessee Parenting Plan!  Additionally, you can find a copy of the statute HERE.

4 Requirements for Parents Relocating after divorce 

First, before moving you must send a notice to the other parent that contains the following information:

(1) Statement of intent to move
(2) Location of proposed new residence
(3) Reasons for proposed relocation and
(4) Statement that absent agreement between the parents or an objection by the non-relocating parent within thirty (30) days of the date notice is sent by registered or certified mail in accordance with subsection (a), the relocating parent will be permitted to do so by law.

Next, make sure you consult an attorney if you need to send the notice and consult the Parenting Plan you signed. 

Additionally, If receive a notice that the other parent intends to move with your child, contact a Tennessee family law attorney as soon as possible.  Thirdly, you have a very limited window (30 days) to dispute the move.
